You may receive a traffic violation on school property.
Chapter 62 (S. 2814 A. 4081)
Effective 11/1/90, amends section 1174 (a) and (b) of the Vehicle and Traffic law to include parking areas, driveways on school or BOCES property, and areas used as a means of access to or egress from such property, within the definition of the term public highway.
In essence, this amendment to 1174 requires motorists who approach a school bus from either direction, which has stopped upon the “public highway” (as defined above) for the purpose of receiving or discharging pupils and has flashing red signal lights activated, to bring their vehicle to a complete halt until the school bus resumes motion or the driver is waved past the bus, either by the bus driver or police officer.
